Protecting the privacy, security and confidentiality of your Personal Information is a fundamental principle in our relationship with you. This Privacy Policy tells you how The Brands Club Inc. collects, uses and discloses Personal Information.

We take the protection of your privacy seriously, and we comply with the Canadian federal privacy legislation known as the Personal Information Protection and Electronic Documents Act (“Act”) and the corresponding Canadian Standards Association National Standard Model Code for the Protection of Personal Information.

Personal Information means information about an identifiable individual, such as name, address, telephone number, e-mail address and credit card information. Information such as name, title or business address or telephone number of an employee of an organization is not considered Personal Information.

The Brands Club Inc. reserves the right to modify this Policy at any time without notice. We therefore recommend that you visit this page from time to time to ensure that you are up-to-date with our latest Privacy Policy.

When you fill out a The Brands Club Inc. application form, The Brands Club Inc. will use the Personal Information you have provided for the following purposes:

• To administer The Brands Club Membership Programs ("Programs"), as described in detail below, and to record and update accuracy of information;
• To communicate information and offers from our Brand Partners (as defined below) to The Brands Club Inc. Members ("Members");
• To understand and respond to Members' needs and preferences;
• To develop, enhance, market and/or provide products and services to meet those needs; and
• To enable Members to participate in offers, promotions and the Programs.
  

The Brands Club Inc. will use the Personal Information Members have provided on the application form to offer or communicate with Members about offers, products and services provided by current and future Brand Partners and Affiliated Stores (as defined below) affiliated with The Brands Club Inc. and other organizations with which The Brands Club Inc. has marketing and other arrangements. These communications may include notifications of sales, special events, store promotions and other exclusive offers. A Member's personal information is not shared with Brand Partners or Affiliated Stores except as provided herein.

THE BRANDS CLUB MEMBERSHIP PROGRAM

When you sign up for The Brands Club Membership program your Personal Information is collected including:

• Name
• Address
• Gender
• Age
• E-mail Address
• Home Phone Number
• Marital Status

Your Personal Information is used to administer the Membership Program and to give you access to rewards, savings and special offers. The information collected regarding your gender, marital status and age is used only for internal The Brands Club Inc. purposes so we can know our members. It is not used in any other way including for data mining or to target offers.

The Brands Club Inc. collects, uses and discloses your Personal Information to administer the Membership Program, such use includes:

• Communicating special offers and rewards from Brand Partners and Affiliated Stores to you during the course of your membership.
• To conduct contests and promotions.
• To send you our monthly Member’s Newsletter.
• To conduct research, statistical, trending and marketing analysis, to understand your needs and preferences and to enhance and ensure the consistency of quality of The Brands Club Programs, services and offers provided by Brand Partners and Affiliated Stores. Such research and analysis is conducted using information that is used and stored in a non-personally identifiable, aggregate form.
• Administration of your Membership Account including Rebate Reward collection, calculation and mailing Rebate Reward cheques.

Once you become a Brands Club Member you are giving a membership number/password that you must use for each purchase made through one of the on-line stores affiliated with The Brands Club Inc. ("Affiliated Stores").

The Brands Club Inc. and our Affiliated Stores

When a Member signs into their Membership Account using their membership number/password, they are giving access to the On-Line Mall and links to the websites of Affiliated Stores, where they may make purchases and earn Rebate Rewards, which are credited to their Membership Account. When a Member clicks on the link to the website of the Affiliated Store from The Brands Club Inc., On-Line Mall website, any use or collection of such Member’s personal information, including personal information collected during the process of making a purchase from the Affiliated Store, is governed by the privacy policy and practices of the Affiliated Store. No personal information about Members is shared between Affiliated Stores, and The Brands Club Inc., except purchase value combined with Membership number/password in order to enable The Brands Club Inc. to correctly calculate and credit Rebate Rewards to the Member’s Account based on the value of purchases made from Affiliated Stores.

When a Member makes a purchase through an Affiliated Store, such Affiliated Stores use “Cookies” to obtain information about purchases made by such Member. The Cookie allows the Affiliated Store to identify that a Member has linked through The Brands Club Inc. website to the Affiliated Store website. The Cookie also contains the Membership number/password. The Cookie contains no other personal information about Members. Members must have Cookies enabled and turned on in order to participate in The Brands Club Membership Program, and specifically in order to make purchases from the on-line mall.

Once purchases on Affiliated Store websites are complete and payment to the Affiliated Store is received, the Affiliated Store reports to its third party information conduit ("Conduit") the following information:

• The fact that the purchase was made by a The Brands Club Inc. Member, through the link from The Brands Club Inc. website to the Affiliated Store website (which information is obtained from the Cookie);
• The dollar value in Canadian or US of the purchase made; and
• The Membership number/password, obtained from the Cookie (collectively the "Report").

The Conduit then sends the Report to The Brands Club Inc., and The Brands Club Inc. uses it to calculate Rebate Rewards and credit such Rebate Rewards to the Member’s account, based on the value of purchases made by the Member. If a report is received in USD, The Brands Club Inc. will convert it to Canadian dollars for the purpose of correctly crediting a Canadian Members’ Rebate Rewards account. The Conduit uses information contained in the Report solely for communicating the Report to The Brands Club Inc. Use of the Report is governed exclusively by the privacy policies of each Conduit. The Conduit maintains a log of all Reports received and sent. The Conduit has no other access to the personal information of The Brands Club Members except what is contained in the Report.

Brands Club Members may have access to coupons and/or promotions and promotion codes online. These coupons/promotions/codes are provided by our Brand Partners of the Affiliated Stores. The coupons/promotions/codes form part of the Membership and are available when Members sign in to their online account using their membership number/password. All coupons/promotions/codes are subject to the terms of use specified on the coupon or promotion detail including the expiry date.

• Third Party Brand Partners and Affiliated Stores. Many of the products and services offered through The Brands Club Inc., are offered and sold by third parties that are our Brand Partners and Affiliated Stores (e.g. retailers and other vendors.). When you choose to order a Brand Partner and/or Affiliated Store product or service, you will disclose information to the Brand Partner and/or Affiliated Store, and/or grant them permission to collect, use and disclose information about you. Collection, use and disclosure by Brand Partners and Affiliated Stores of your Personal Information is governed exclusively by their privacy policies and practices. The Brands Club Inc. is in no way responsible and makes no representations or warranties regarding use of your Personal Information by Brand Partners or Affiliated Stores, or the privacy practices of such third parties. We will not disclose your Personal Information to Brand Partners or Affiliated Stores, except as provided herein.
• Accessing, Reviewing and Changing Your Personal Information. We offer you the ability to automatically review and change the Personal Information you submit to us by logging on this website using your membership number/password and entering in the new information yourself. You can change your password, email address, contact information, user preferences and other information by going to your "My Account" page of the Membership website.

The Brands Club Inc. does not sell, trade, or otherwise provide to third parties any Personal Information it has obtained except as described in this Privacy Policy or unless we have express consent from Members.

From time to time, Members may be asked to provide additional Personal Information. If Members choose not to provide this information, it will not affect their ability to redeem exclusive offers from The Brands Club. Should we wish to use Member’s Personal Information for purposes other than those stated above we will always ask the Member before doing so.

Should Members choose not to consent to the use of their Personal Information for the purposes described herein, including administration of the Programs and contacting them regarding promotions and special offers, Members will be unable to participate in the Programs or certain aspects of the Programs. Contact us by mail, e-mail or telephone to request opt-outs for the receipt of certain materials and we will disclose to you how it will affect your participation in the Programs.

The Brands Club Inc. may disclose Personal Information to organizations hired to perform services on our behalf. Personal Information will only be provided to organizations providing services to The Brands Club Inc. if they agree to use such information solely for the purposes of providing services to The Brands Club Inc., under the instruction of The Brands Club Inc. and to act in a manner consistent with this Privacy Policy. We disclose only as much of the Personal Information as is required by these agents to perform the task they have been retained to perform. Please note that we will release Personal Information if in our opinion we are required to do so pursuant to law (including the Act), or by a search warrant, subpoena, court order or other legal process.

Upon your request, The Brands Club Inc. will deactivate your account, contact information and all other information from our active databases. We will retain certain personal information only to finalize any of your account details, prevent fraud, enforce our agreements with you, and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your personal information would be completely removed from our databases immediately in response to your request. However, such personal information will be available only to the appropriate The Brands Club Inc. personnel.

Member Personal Information is processed and stored in secure and confidential databases in Toronto, Ontario. We do have physical measures, organizational measures and technological measures in place to ensure protection of your Personal Information.

Member Personal Information is considered an asset; if our business is transferred to a new owner, Personal Information will be given to and considered an asset of the new owner. Personal Information will only be used by the new owner for the same purposes for which it was collected, used or disclosed by The Brands Club Inc., unless you agree otherwise.
